Legend Ledger & Vanguard Program — Terms & Conditions
These Terms govern participation in the Apres Leisure Legend Ledger and Vanguard Program (the “Program”). By earning Lore Points, holding Legend status, or operating as a Vanguard, you agree to the ground rules below. Apres Leisure may update these Terms; material changes will be posted on this page with a revised effective date.
Effective Date: June 22, 2026
1. Nature of Lore Points
Lore Points are non-financial, promotional markers that recognize engagement within the LeisureVerse. They are not currency and carry no cash value.
- Lore Points have no monetary value and cannot be redeemed for cash, refunded, or exchanged for money.
- Lore Points are not transferable or tradeable between members and may not be sold, gifted, or assigned.
- Lore Points are a revocable promotional benefit, not property, and confer no ownership or contractual right to any payout.
- Apres Leisure may adjust, expire, suspend, or void Lore Points in cases of error, fraud, abuse, returns, or program changes.
- Lore Points balances and Legend status are tracked at Apres Leisure’s discretion; our records are the authoritative source in any dispute.
2. 30-Day Escrow & Clawback Policy
To protect program integrity and ensure rewards reflect completed, retained purchases, point attributions and any associated Vanguard commissions are held in a pending state before they are confirmed.
2.1 Escrow Period
- Lore Points and Vanguard commissions earned from a qualifying order enter a 30-day escrow period beginning on the order’s payment date.
- During escrow, points and commissions are marked “Pending Validation” and are not available for payout, tier benefits, or reward redemption.
- At the end of the escrow period, validated entries are released and marked “Approved for Payout,” provided the underlying order remains in good standing.
2.2 Clawback Conditions
Apres Leisure reserves the right to reverse (“claw back”) points or commissions before or after release if the qualifying activity is reversed or found invalid, including where:
- The underlying order is refunded, charged back, canceled, or returned in whole or in part.
- The order was obtained through fraud, manipulation, fake accounts, or violation of these Terms.
- A pricing, attribution, or system error resulted in points or commissions being awarded incorrectly.
- For partial refunds, points are reduced proportionally to the retained order value; orders that fall below the qualifying threshold are flagged for manual review.
- A clawback reduces a member’s balance below zero, in which case the negative balance is offset against future earnings.
2.3 Margin Protection
The escrow and clawback mechanism exists in part to protect Apres Leisure’s operating margins. Apres Leisure may modify reward rates, commission structures, and qualifying criteria at any time to maintain program sustainability. Adjustments apply prospectively and do not retroactively reduce already-released, validated balances except in cases of error, fraud, or order reversal.
3. Vanguard Operator Responsibilities & FTC Compliance
Vanguard Operators who promote Apres Leisure or earn commissions act as endorsers and must comply with the U.S. Federal Trade Commission’s endorsement guidelines and all applicable advertising laws.
- Disclose your relationship with Apres Leisure clearly and conspicuously in every promotional post using #Ad and #ApresPartner.
- Place disclosures where they are easily noticed — at the start of the caption or visibly within the content, not buried among other tags or behind a “more” link.
- Make only truthful, substantiated claims. Do not misrepresent products, results, or your personal experience.
- Follow each platform’s own disclosure tools and advertising policies in addition to these requirements.
- Vanguard Operators are independent participants, not employees or agents of Apres Leisure, and are responsible for their own content, taxes, and compliance.
- Apres Leisure may suspend or remove Vanguard status and withhold or claw back commissions for non-compliance.
4. Philanthropic Pledge
1% of profits support mental health, environmental and rotating initiatives.
5. General Terms
- Apres Leisure may modify, suspend, or terminate the Program, in whole or in part, at any time.
- The Program is void where prohibited and subject to all applicable laws and regulations.
- Participation is conditioned on compliance with these Terms; violation may result in forfeiture of points, status, and commissions.
- These Terms should be read together with the Apres Leisure general Terms of Service and Privacy Policy.
6. Governing Law & Jurisdiction
These Terms and any dispute or claim arising out of or relating to the Program, its subject matter, or its formation are governed by and construed in accordance with the laws of the State of Wyoming, without regard to its conflict-of-law principles. All legal definitions and dispute processing under these Terms are anchored to the State of Wyoming.
The parties agree that the state and federal courts located in the State of Wyoming will have exclusive jurisdiction over any dispute arising from these Terms, and each party submits to the personal jurisdiction of those courts.
